1. General aspects

The "Terms and Conditions" contract regulates the use of the Rookeyz platform (hereinafter referred to as the "Platform") owned and managed by SC Rookeyz Jobs SRL (hereinafter referred to as the "Company") based in Slatina, Olt county by the persons and companies who use the platform (hereinafter referred to as "Users" or "Candidates" and "Employers", as the case may be)

2. Acceptance of the user agreement
This Agreement ("Terms and Conditions") applies to the Rookeyz platform, its services and content. Access to the platform, the services, and the content of the platform are offered on the condition that you accept the terms of this contract without any modification.

The use of the platform (including access, browsing, creation of an account, and purchase of services) by you as a registered or unregistered user constitutes an implicit agreement to comply with all the terms and conditions stated in this document with all the effects and consequences arising from it (including updates to this document).

If you do not want to accept the "Terms and Conditions" established in this contract, stop using the Rookeyz platform and the services offered through it.

By using the platform, you assume the responsibility to visit this page periodically to check and read the "Terms and Conditions".

SC Rookeyz Jobs SRL reserves the right to revise and modify this Agreement whenever it deems necessary, without prior notification to the Users, keeping the Users up to date with the changes remaining the responsibility of the Users.

3. Rookeyz Services
The platform provides individual users looking for employment opportunities (hereinafter referred to as "Candidates") the opportunity to access the job search service that is published on the platform and also connects Candidates with the companies that publish these job opportunities (hereinafter referred to as "Employer(s)").

The platform also provides users with access to a library of resources in text and video format that aim to support candidates in identifying the most suitable career options for their own person.

By using the platform, users understand and accept the fact that the services offered can and do include advertising (paid or as a result of a contract of another nature with employers). As a user, you understand that advertising is necessary to support the operation of the platform and the provision of the services you benefit from. Advertising may include: priority display of certain job ads, newsletter ads, administrative messages, e-mails, direct WhatsApp messages or invitations to Whatsapp Broadcasts. Advertising and advertising messages are implicit in the quality of user of the platform and you understand that there is no option to give up these messages except by stopping the use of the platform.

Within the Platform, by using it according to its intention, interactions take place between candidates and employers directly. As a user, you acknowledge that the platform is not directly involved in the transactions that take place between the Candidate and the Employer.

4. Use of the Platform
By using the platform, you agree to comply with all the terms and conditions of this contract and take note of the personal data processing conditions as stipulated in the "Privacy Policy" page of the platform.

For the full use of all services within the platform, you must create a specific user account for the role you have in the platform (candidate or employer) and agree to comply with the following conditions:
a) To provide true, complete and accurate data in the form in which you are asked to complete the registration;
b) To maintain and update the registration data whenever necessary with the changes that have occurred so that they are true, complete, and accurate. In the case of Employer users, it is necessary that these changes take place within 30 days of their appearance.
c) In case of providing information that is not in accordance with reality, is incomplete or inaccurate, the platform reserves the right to suspend and close your account, as well as to refuse future access to the use of the platform and platform services.
d) As an Employer you agree that you are responsible for all video and content uploaded by you on the platform.
e) You agree that Rookeyz takes no responsibility for any content either displayed, used and/or disseminated in any videos.
f) Personal data, access passwords or any other information as part of the security procedures regarding the use of the platform and services on the platform, must be treated by you as confidential and you must not disclose them to any third party.
g) You are prohibited from creating an account using false information and/or a false identity, or on behalf of someone other than yourself. As a user, you can only have one account and you agree that you shall not have more than one. Your login shared by multiple people is not permitted.
h) If your account has been banned or removed and have been restricted from using the platform, you agree not to create another account.
i) We do not guarantee that the Platform, the Services or any content on them will always be available uninterrupted or error-free, and we reserve the right to withdraw, suspend or modify the services or functionality we provide through the Platform without prior notice for business and operational reasons. We will try to inform you in a timely and reasonable manner about any suspension or withdrawal.
j) We are also not liable if, for any reason, the Platform is unavailable at any time or for any period.
k) At the moment, the services within the platform are made available free of charge to Candidates, but that can be modified depending on strategic business decisions.
l) We reserve the right to deactivate any user account if, in our opinion, you have violated the terms and conditions stipulated in this contract.
m) We do not hereby warrant that the Rookeyz platform will be secure or free of errors or viruses.
n) To be able to use the platform, you accept that you are fully responsible for configuring the technology and software you need to be able to use this platform.
o) The virus protection software for the equipment you use is entirely your responsibility.
p) Abusive use of the platform by knowingly introducing viruses, malware, worms, trojans, logic bombs, or other malicious materials, software, or data that can impact the platform or its users is prohibited.
q) Attempts to gain unauthorized access to the platform, site, server, information stored within the platform, and user accounts are prohibited.
r) It is forbidden to attack the platform through a denial-of-service attack or through a distributed denial-of-service attack.
s) If you violate the activities prohibited by this contract, you may be committing a crime. We reserve the right to report such violations to the appropriate law enforcement authorities and will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, we reserve the right to immediately terminate your right to use the Platform.
t) You may link to our home page provided you do so in a fair and legal manner and do not harm our reputation or take advantage of it.
u) Links formulated in such a way as to suggest any form of association or endorsement on our part, where there is no explicit agreement on our part, are prohibited.
v) Linking to our platform on websites that are owned by you is prohibited.
w) It is prohibited for our platform to be embedded on another site, nor may you create a link to any part of our platform other than the home page.
x) We reserve the right to withdraw login permission without notice.
y) The website you are connecting to must comply in all respects with the content standards set out in these terms and conditions.

As a User you agree not to:
a) Use the platform or its content for any purpose, other than the Permitted Purpose;
b) Resell, resupply or repackage the Software that runs the Rookeyz platform;
c) Use another person’s name, account, identity or password without the persons written consent, or use the platform while impersonating  another person or allow any other person or third party to use Your name, account, identity or password without your written consent, or any other person or third party to use the platform whilst impersonating another person;
d) Use any spider, robot, scraper or other automated or manual process to monitor, access or copy content or information from the platform;
e) Incorporate any part of the platform into any other website or software without Rookeyz explicit, written consent ;
f) Post content that impersonates any person or entity or that may infringe the Intellectual Property Rights of any person or entity;
g) Post content that is unlawful, false, misleading, defamatory, slanderous, libelous, obscene, pornographic, indecent, lewd, harassing or advocates harassment of another person, threatening, abusive, invasive of privacy, inflammatory, fraudulent, questionable or otherwise considered to be offensive, such as content that promotes hatred, racism, bigotry or physical harm, of any kind against any group or individual;
h) Post content that would constitute, encourage, promote or provide instructions for the conduct of an illegal act, any criminal activity, or violate the rights of any person;
i) Post content which contains the private and/or personal information of any person;

By agreeing to be bound by the Terms, we hereby grant you a non-exclusive, non-transferable license to use the Platform. The Platform may be modified and updated to reflect changes to the offered services, the needs of our users, and our business priorities.

If you know or suspect that someone else has access to your user account without this person having your explicit permission, please follow the password reset process or contact us at hello@rookeyz.com.

Deleting the account and of the personal data

To delete your account, you have to login to your user account and then follow these steps:
1. Access the "Settings" section.
2. Press the "Delete account" link located at the bottom of the page.

4.1. Use of the platform by candidates

When you access the Rookeyz platform, you have the possibility to register and create an account (hereinafter referred to as "Account")

To be able to use the platform and create a User account, as a Candidate you must be at least 16 years old at the time of account creation. Accessing the platform and using the services is prohibited for persons under 16 years of age.

If your registration is accepted, you are allowed to use the platform and its services.To create your account you will be asked to provide us with your name, email address and work preferences. Also, within your account, to facilitate your connection with the Employer, you can provide us with a link to your LinkedIn profile and, possibly, other relevant professional profiles.

You will be asked for information about your work history, education and other data related to your professional history.

Within the platform, you are offered the opportunity to create or upload your own CV in our database.

For information on how we collect, store and process your personal data, please see our Privacy Policy within the Platform.

If you need assistance in using the platform, you can contact us by e-mail and one of our consultants, with your explicit consent, will be able to create a user account or modify the account you already have.

Once the account is created and after completing the data and preferences within it, you have the possibility to fully use the job search functionalities, you will be able to apply for them and you will be able to communicate with potential Employers about employment opportunities.

The information provided in your account (preferences and contact details) and uploaded CVs will be made available to Employers for employment purposes.

The information and CVs that you upload on the platform in your account, can and may be made available to Employers for employment purposes. When you register your CV in our database, it will automatically be made public to selected Employers. Access to our database is limited only to employers, HR firms and specialists, and personnel managers, but we cannot and do not guarantee that other third parties cannot access our database. The platform is not responsible for the use of resumes by third parties who have accessed resumes while they are in our database.

If you decide to terminate your account, Employers will no longer have access to your data. Employers that access your information during the period that you’ve had an active and visible CV, have the possibility to download your information on their own storage devices. In this case, even if you choose to delete your account, they will still have access to the information that they have downloaded. The employers are independently and fully responsible for how they use and store your data.

There is a possibility that some employers that publish their recruitment announcements through the Platform may present a misleading, incomplete, incorrect, or aggressively oriented reality to other social categories.

The “Terms and Conditions” require truthfulness and fairness on the part of Employers, but not all Employers choose to follow the rules. You have the full responsibility to use discernment and discretion when you analyze the job post and before going to an interview, taking a job or making an investment, or any other action involving the use of your own or third-party funds or resources. You agree that the platform isn’t responsible in any way for the job postings, the accuracy of the information provided, and the way your employment experience unfolds with the employer.

4.2. Obligations and Rights of Candidates

Through the Platform, as a candidate, you have the possibility to search for jobs, view content that can help you better understand what job is best suited for you and you can apply for jobs and connect with Employers to discuss job opportunities. Currently, the use of the platform is free for Candidates, the only requirement being that you have to sign up, create an account and fill in your resume.

The jobs listed are created and provided by Employers who are users themselves, over which Rookeyz exercises no control.

Rookeyz has no control over the jobs listed in the platform, our responsibility being that of only providing the platform, services needed to post and curating the content that is posted in order to make sure it is in accordance with the “Terms and Conditions”.

You also understand that we are not responsible for the content posted on the platform and as such we cannot confirm the accuracy or completeness of any job recommendation or other information submitted by any Employer or other user.

Rookeyz assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any job recommendations, Employer information, salary statistics, blog posts, screening questions and responses, and assessments information which may be available on the platform.

When you are using the platform to view, upload, send, receive or store information we may use such information for internal business purposes including but not limited to data analysis, quality control, or to refine the platform or any other product or service (including to provide better search results and other job posts for Candidates and Employers), through automated means or otherwise.

Rookeyz reserves the right to send messages, notifications, emails, or WhatsApp messages according to your activity. This, however, does not mean that Rookeyz is obligated in any form to do so. We disclaim all warranties regarding the transmission or storage of such messages, emails, notifications and other means of communication with you.

5. Intellectual property protection and usage rights

Rookeyz is the owner or the licensee of all patents, utility models, rights to inventions, copyright and neighbouring and related rights, moral rights, trade marks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world ("Intellectual Property Rights") in our platform, and in the material published on them including but not limited to text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software, job adverts, company profiles, blog posts and any other form of information capable of being stored in a computer that appears on or forms part of this platform, together with any such content uploaded by users of the platform ("Content"). Except as expressly set out in these Terms all such rights are reserved.

You are allowed to print off one copy and may download extracts, of any page(s) from our platform for your personal use.

You are not allowed to modify the paper or digital copies of any Content you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of Content on our Platform  must always be acknowledged.

You must not use any part of the Content on our Platform for commercial purposes without obtaining a licence to do so from us in a written consent.

If you print off, copy or download any part of our platform in breach of these Terms, your right to use our platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Nothing on this platform shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the platform without the owner's prior written permission.

This platform may include information and materials uploaded by other users of the platform, including to bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on our platform do not represent our views or values.

The Content on our Platform is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the Content on our Platform.

Although we make reasonable efforts to update the information and Content on our Platform, we make no representations, warranties or guarantees, whether express or implied, that the Content on our Platform is accurate, complete or up to date. Whenever you make use of a feature that allows you to upload content to our Platform, or to make contact with other users of our Platform, you must comply with the content standards set out in our Acceptable Use Policy.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our Platform will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our site a limited license to use, store and copy that content and to distribute and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on our Platform if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.You are solely responsible for securing and backing up your content.

6. Prohibited use of the platform and its services
You are prohibited from using the platform for any of the following purposes:
a) Copying, storing, transmitting, making of electronic information or data of Content protected by copyright from the platform, without the explicit permission of the owner.
b) In any way that might cause or causes damage to the platform, interferes with its functionality or with any other user’s use or enjoyment of the platform.
c) In any way which is illegal, unlawful, abusive, harmful, harassing, objectionable or threatening or in breach of regulations, applicable law or governmental orders.

7. Links and linking to other websites

You may link to our home page provided you do so in a fair and legal manner and do not harm our reputation or take advantage of it.

Links formulated in such a way as to suggest any form of association or endorsement on our part, where there is no explicit agreement on our part, are prohibited.

Linking to our platform on websites that are owned by you is prohibited.It is prohibited for our platform to be embedded on another site, nor may you create a link to any part of our platform other than the home page.

We reserve the right to withdraw login permission without notice.

The website you are connecting to must comply in all respects with the content standards set out in these terms and conditions.

We take no responsibility for the content of websites that link to our own and disclaim liability for any and all forms of loss or damage arising out of their use.

If there is an inclusion of a link to another site on this platform, that does not imply any endorsement of the sites themselves or of those in control of them.

8. Limitation of Liability
By accessing and using the platform you agree that you have relied and are relying on your own skill, judgment, and abilities in selecting, using the services, and obtaining the results you intend to obtain in accordance with the terms and conditions in this contract.

The services offered by the platform may not be completely free of errors. The use of the platform does not guarantee that the services and the functions will meet your requirements or that the services will be error-free or uninterrupted.

Backup of the work you performed within the platform is recommended.

Rookeyz does not exclude or limit in any way the liability it has towards you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We are only responsible to you for loss and damage directly caused by us. If we fail to comply with the terms established in this contract, we are responsible for the foreseeable loss or damage you suffer as a direct result of this failure. We are not responsible for any damage or loss that is not foreseeable.

Damage or loss is foreseeable only if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

Rookeyz will not be liable to you for any loss of profit, loss of business, business interruption, loss of business opportunity, goodwill or data arising in connection with this agreement.

9. Major force

Rookeyz cannot be held responsible for any delays or errors in the content provided on our platform, or for damages resulting directly or indirectly from causes beyond our control. This includes, but is not limited to: failure of communication and technical equipment, viruses, hacking, etc.

10. Applicable law and jurisdiction

The applicable law and jurisdiction that governs the rights and obligations from these terms and conditions agreement is the Romanian law. Any and all disputes that cannot be settled outside of court will be settled in the competent courts of the locality were the Rookeyz headquarters are located.

11. General

Any and all variations, modifications and adjustments of these terms depend solely on Rookeyz. Your acceptance of the terms with their modifications will be implicit by the use and continuation of use of the platform and its services.  

This agreement does not generate any partnership, employment, joint venture or any similar relationship between you and Rookeyz.

If any provision of this "Terms and Conditions" agreement is considered invalid by the competent legal forums, the invalidity of such a provision will not affect the validity of the other provisions of the "Terms and Conditions", these remaining in force. These "Terms and Conditions" constitute an agreement concluded between you and Rookeyz regarding the use of the platform.

By using this platform, you agree to always allow Rookeyz (or Rookeyz representatives / agents) access to your account in order to audit the use of the platform and help you in the use of the platform when needed.

You cannot transfer any of the rights under these Terms and Conditions to any other person. Rookeyz may transfer our rights under the Terms and Conditions where we reasonably believe your rights will not be affected.

The Terms and Conditions in conjunction with the Privacy Policy contain the whole agreement between the you and Rookeyz relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the Terms and Conditions.
